Investigation into complaint of assault by a Derbyshire officer concludes

The findings from an Independent Police Complaints Commission investigation into a complaint that an officer assaulted a man have been published.

On 28 July 2014 Derbyshire Constabulary responded to reports of criminal damage and a disturbance in the Peartree area of Derby. Police officers attended Holcombe Street and arrested the suspect.

The following day a member of the public contacted Derbyshire Police and provided a short video clip which she stated showed an officer involved in the arrest assaulting the man. She also said that the officer had kicked the detainee but that this was not captured in the footage.

Derbyshire PSD began an investigation into the complaint but due to subsequent media interest voluntarily referred the matter to the IPCC on 4 September 2014.

The IPCC subsequently began an independent investigation, during which it interviewed the officer concerned, other officers present as well as members of the public present. They also reviewed video footage and paperwork completed after the incident. The investigation also sought expert opinion regarding the use of force depicted on the video.

The IPCC concluded the investigation in March 2015 and presented all the evidence to Derbyshire Constabulary along with the opinion that a misconduct meeting could find that the force used by the officer was unnecessary.

Following consideration of the report, Derbyshire Police found that there was no case to answer for gross misconduct and decided not to commence misconduct proceedings. However the force has elected to take management action in respect of a comment made by the officer during the arrest. The IPCC is satisfied with the approach taken by the force in response to the report.
