Western Power Distribution: court refuses permission to bring judicial review of decision on electricity distribution losses

Western Power Distribution applied for permission to bring a judicial review of our decision on electricity distribution losses. This was considered by the High Court on 20 November 2014. It ruled in favour of Ofgem, refusing Western Power Distribution’s application and thereby upholding our decision.

We consulted extensively over the past four years on closing out the DPCR4 losses incentive mechanism, with our final decision seeing £161 million returned to consumers.

The document follows our October 2013 consultation on restatement of 2009-10 losses data. It contains the further decisions we have made to close out the losses incentive mechanism for the fourth distribution price control review. Alongside this document we have published a direction with the final values to be recovered by each DNO.
