Guidance for businesses,
Government departments and advisers detailing the approach and process being
trialled by the CMA to provide Short-form Opinions on the application of
competition law.
The CMA Short-form Opinion (SfO)
trial process provides guidance within a prompt timetable to businesses,
Government departments and advisers on the application of competition law to
prospective agreements or other forms of cooperation raising novel or
unresolved questions, the clarification of which would benefit a wider
audience. The CMA believes that the SfO process can provide a further valuable
tool to assist businesses in complying with competition law.
The process is available for a
limited number of cases per year. This guidance provides further detail on the
purpose of SfOs, when a SfO might be available and the process for requesting
and providing a SfO.
