The Independent Police Complaints Commission investigation into the circumstances surrounding the death of Philmore Mills at Wexham Park Hospital, Slough, on 27 December 2011 was completed and a file was sent to the Crown Prosecution Service (CPS) in January 2013. The CPS asked for a further expert report which they were provided with in June 2013. As part of the IPCC investigation, two Thames Valley Police officers and one civilian security guard were interviewed under criminal caution.

The CPS has decided that there is insufficient evidence to charge any individual in relation to Mr Mills’ death and all concerned parties have been notified. As a result, the IPCC will now complete its investigation report and provide it and the underlying material to the Coroner in advance of an inquest.

Mr Mills, an in-patient at the hospital,  died after he was restrained by two police constables who had been called to assist hospital security staff with a disturbance. 

IPCC Associate Commissioner Guido Liguori said:

"My thoughts are again with Mr Mills’ family at this difficult time. Mr Mills’ death will now be subject to an inquest where the evidence in this case will be tested in a coroner’s court before a jury. We will publish our report once those proceedings have concluded.”
