New triggers help pave the way to a comprehensive Land Register

New triggers help pave the way to a comprehensive Land Register

LAND REGISTRY News Release (06/09) issued by COI News Distribution Service. 24 March 2009

Two new events will be added to the current legal triggers for compulsory first registration of title when the Land Registration Act 2002 (Amendment) Order 2008 comes into force on 6 April.

They are:

* The appointment of a new trustee of unregistered land held in trust

* The partitioning of unregistered land held in trust amongst the beneficiaries of the trust.

The Order has been made following a consultation by Land Registry on behalf of the Lord Chancellor. The consultation ran from 19 November 2007 until 29 February 2008. The new triggers will help Land Registry achieve its long-term objective of creating a comprehensive land register for England and Wales. Land registration makes property transactions easier and gives the best possible legal protection to landowners. Trustees of unregistered land can still apply for voluntary first registration and receive the 25 per cent discount on the normal fee until they appoint a new trustee, which would then trigger compulsory first registration.

More information is available in Important developments on http://www.landregistry.gov.uk and Land Registry publications, Practice Guide 1 - First Registrations, Practice Guide - 14 Charities and Practice Guide - 24 Private trusts of land are being updated for 6 April.

Notes to editors

1. The Order was made following a favourable response to the consultation on new triggers (19 November 2007 until 29 February 2008). The consultation report is available by following the 'consultations' link on http://www.landregistry.gov.uk

2. As a government department established in 1862, executive agency and trading fund responsible to the Secretary of State for Justice and Lord Chancellor, Land Registry keeps and maintains the Land Register for England and Wales. The Land Register has been an open document since 1990.

3. With the largest transactional database of its kind detailing over 22 million titles, Land Registry underpins the economy by safeguarding ownership of many billions of pounds worth of property. Just over two thirds of land in England and Wales is currently registered
