Car emissions: EC requests further legal clarification from 5 Member States

The EC has decided to send additional letters of formal notice to Germany, Greece, Luxembourg, Spain and the United Kingdom requesting further information on their application of EU vehicle type approval rules (Directive 2007/46/EC).

Following a careful assessment of the responses by Germany, Luxembourg, Spain and the UK to the letters of formal notice sent in December 2016, the Commission is seeking additional clarity on why these Member States did not apply penalties to a car manufacturer that used defeat devices banned under EU law. The Commission is also requesting further information from Greece about the national system of penalties set up in accordance with EU type approval legislation.The Commission also closed the case against Lithuania, considering that the penalty system put into place is compatible with EU legislation.
