Data Protection Bill examined by Peers

The Constitution Committee recently published a report on the Data Protection Bill [HL] which repeals and replaces the Data Protection Bill 1998, and seeks to update data protection laws for the digital age.

Report

The Committee draws attention to the interlocking relationship between the powers of the Data Protection Bill and current EU law. The Committee says that Bills such as this need careful scrutiny to ensure that their provisions will continue to function post-Brexit without needing significant amendment.

The Committee also draws attention to the large number of delegated powers in the Bill; an increasingly common feature of recent legislation and one which causes concern. The Committee says that in light of Brexit and the rapidly changing nature of digital technologies, the Government's desire to future-proof legislation should be balanced against the need for Parliament to scrutinise and, where necessary, constrain executive power.
