European Statutory Instruments Committee publishes third report of Session 2019-21

Following the Committee’s meeting on Tuesday 24 March, its third report of Session 2019-21 has been published.

The report details three proposed negative instruments laid by the Government, and recommends that the Carriage of Dangerous Goods and use of Transportable Pressure Equipment (Amendment) (EU Exit) Regulations 2020 be subject to the affirmative procedure.

The report also recommends that the Harbours and Highways (Environmental Impact Assessment) (Amendment) (EU Exit) Regulations 2020 and the Regulation (EC) 1370/2007 (Public Service Obligations in Transport) (Amendment) (EU Exit) Regulations 2020 be subject to the negative procedure.

The Government can reject or accept recommendations made by the Committee, but has to provide a written statement if it chooses to reject a recommendation to make a statutory instrument affirmative.
