IPCC refers file on Metropolitan Police Service officer to the CPS

Following its investigation into the actions and behaviour of a Metropolitan Police Service (MPS) officer, the Independent Police Complaints Commission (IPCC) has referred a file to the Crown Prosecution Service (CPS) to consider possible assault offences.

The IPCC started an investigation into an allegation of excessive use of force after a man, who was 22 at the time, sustained a fractured jaw following an incident in Wembley in December 2016.

IPCC Operations Manager Adam Stacey said:

“Following our investigation I have now decided to make a referral to the Crown Prosecution Service as there is an indication that a police constable may have committed a criminal offence.

“It is now for the CPS to consider whether to bring criminal charges. I have also sent our investigation report to the MPS which has agreed that the officer has a case to answer for gross misconduct proceedings relating to his actions in December 2016.”

The referral relates to an incident which took place at the junction of Elm Road and St John’s Road, Wembley, on Monday 19 December 2016. The injured man, who was arrested, required hospital treatment.

A referral to the CPS is made when the IPCC investigation indicates that a criminal offence may have been committed. It does not mean that criminal charges will necessarily follow. The CPS will decide whether charges should be brought, based on the test set out in the Code for Crown Prosecutors.
