West Midlands Police custody officers cleared of assault

Two West Midlands Police custody officers were found not guilty of assault by beating following a trial at Birmingham Magistrates Court on Monday (9 September).

Detention Officer Steve Orton and Police Sergeant Howard Price were accused over an incident at Oldbury custody unit on 11 November last year when it was alleged that a man had been kicked and stood on while handcuffed on the floor of a cell. 

The officers denied the charge which was authorised by the Crown Prosecution Service (CPS) following our investigation, completed in May.

We determined that both officers had a case to answer for gross misconduct and steps will now be taken to progress the associated disciplinary matters with the force.
