An optional system of European contract law: advice to the UK Government

In October 2011 the European Commission proposed a new 'Common European Sales Law', which traders could choose to use in cross-border contracts.

The Law Commission and Scottish Law Commission have published an advice to the UK Government on the advantages and problems of this.

Law Commissioner David Hertzell says “There is a case for a new optional consumer code to cover distance selling across the European Union – but we are not sure that the current text always strikes the right balance”.
