Statement following Competition Appeal Tribunal's judgment

COMPETITION COMMISSION News Release (09/09) issued by COI News Distribution Service. 4 March 2009

The Competition Commission (CC) has issued the following statement after the Competition Appeal Tribunal (CAT) published its judgment on an appeal by Tesco in relation to the CC's Groceries report:

The judgment has not questioned our findings in the groceries report nor our proposed measures. Specifically it has not challenged the rationale for a competition test to tackle local supermarkets monopolies or its design. The appeal was upheld on the narrow grounds that certain considerations about how the test would work and its costs and benefits should have been explored further in the report.

We will now study the judgment closely before deciding our next steps. We are keen to maintain progress with all the measures and recommendations that resulted from our report and are in the process of consulting on those actions designed to address problems in the supply chain.
