EXPERT WITNESS

OUR PROCESS

Eric Findlay acts as an expert witness in water related schemes including Sewerage, Water Supply and Flood Defence. His intimate knowledge and insite of Water Company design policy makes him particularly suitable

Determination

  • Determination is a unique form of arbitration which complies with the normal legal rules. It is useful where the parties are in dispute about the capabilities of the plant or process and do not wish to employ expert witnesses and a court hearing.
  • We carry out a detailed investigation of the process / plant and consider all the relevant correspondence and hear the parties' view.
  • On completion we issue a Determination which is similar to an award in arbitration. It is more investigative than normal arbitration and relies on our specialist knowledge of the design / construction or manufacture etc.
  • The parties through prior agreement drafted by their solicitors agree to be bound by our determination

ROTATING BIOLOGICAL CONTRACTORS  (RBC)

RBCs fail in fatigue, without warning, resulting in at least a significant reduction in treatment capacity. Our Principal, Eric Findlay, when with Severn Trent Engineering, worked with Cranfield University, School of Engineering in the 1990s to develop a plant which was defect free for a minimum of 20 years. Those RBCs have more than achieved their 20-year requirement. When at Copa Ltd, the plant was warranted defect free for a minimum of 20 years and over 100 installed throughout the UK. We understand these are still operating satisfactorily.

We are able to advise on the Validation of RBCs to achieve the Severn Trent Water Limited / Cranfield Standard. This should ensure the problem of short life failure experienced in the 1990 's and in the USA is avoided.

RBC REMEDIATION

RBCs are investigated when they are thought to be are nearing the end of their useful life and recommendations made on the most cost effective solution. This minimises the effect of costly and inconvenient loss of treatment capacity allowing the operator to plan for, or avoid, the loss of treatment capacity. Our report covers all aspects including process, civil and mechanical engineering aspects and if required site layout.

It can, if required, consider the effect of future planned development on the process including duplication.

SMALL WORKS DESIGN

Our expertise is not solely limited to RBCs but covers the whole range of sewage treatment plants, both large and small including sea outfalls. We are from time to time required to investigate the existing sewage treatment capacity and to make recommendations on the suitability to treat existing and /or future development.

In many cases there is no historic data to suggest the capacity and in many cases the capacity of individual units do not agree with each other. Some are built over or included in an inaccessible shelter and are not instantly recognised as sewage treatment works. We investigate the catchment to establish the history and develop the most appropriate design solution for pubs, golf clubs and caravan parks etc. including dealing with the various statutory bodies including the Environment Agency. The most appropriate sewage treatment works is recommended. This might be an RBC but could equally be another suitable small works or larger process,

PROJECT APPRAISAL

  • Selection difficulties can arise when there are several solutions to the same problem and no means of differentiating between the costs leaving the Feasibility Study inconclusive.
  • Following a detailed Feasibility Study, this service provides advice to help the client select the most cost effective solution. It Involves the technical and financial or economic appraisal of the feasible options employing Discounted Cash Flow analysis techniques.
  • The service can include the full feasibility study and report or simply the analysis based on the Client's estimated costs

CONTRACT CONSULTANCY

We have investigated contracts where there is a dispute between the main contractor and his supplier with a view to the resolution of any difficulties

FEASIBILITY STUDIES

It is common on overseas schemes to split a scheme into various stages eg feasibility, design assessment and  preparation, contract preparation,  bid assessment. We are able to carry out any of the associated activities
