Just some of the specialist employment law advice that we can provide your organisation with advice upon is as follows:

Employment Contracts, policies and procedures: An effective employment contract, plus a full set of non-contractual policies and procedures, are essential the effective management of staff. Well drafted policies frequently help avoid problems arising in the first place.

Recruiting an employee with a disability or other special circumstances: It is essential to have a thorough understanding of employee rights in the recruitment process, including potential issues in relation to disability (which may not have been apparent from the job application) or race. We can help support your organisation in this process.

Support with Grievances: Complex grievances, often including elements of discrimination, bullying or harassment, can be extremely difficult for an organisation to manage without the dedicated professional support that we are able to provide.

Support with ACAS Early Conciliation: Employees need to submit an ACAS Early Conciliation request if they are contemplating submitting an Employment Tribunal claim. This can therefore be a key stage at which to get legal advice and carefully consider how best to respond.

Support with Disciplinary procedures: Handling a disciplinary effectively, fairly and safely can be a challenge, especially when serious misconduct has been alleged and when dismissal might result.  We will help you achieve a result that avoids or minimises the risk of legal proceedings.

Support with Restructuring, Reorganisation or Redundancy: It is easy to make errors in restructuring, reorganisation or redundancy exercises. We can provide your organisation with the support required in order to manage these procedures effectively, fairly and safely.  See also redundancy selection.

Support on TUPE: Many employers are aware of the Transfer of Undertakings (Protection of Employment) Regulations 2006, which may arise when your organisation is tendering for contracts, outsourcing or insourcing certain functions. We can help you effectively manage this notoriously difficult area of the law.

Settlement Agreements: There are a variety of reasons why you may wish to negotiate the exit of an employee from your organisation. We have substantial experience advising employees on how and when to negotiate exit packages, using a Settlement Agreement (otherwise known as a Compromise Agreement) or an ACAS COT3 agreement.

Representation in Employment Tribunal claims: Our solicitors have substantial experience in representing employers to successfully defend Employment Tribunal claims (including unfair dismissal, unfair redundancy, unlawful discrimination, and whistleblowing claims) or to resolve the claims before any hearing in an appropriate manner.

Enforcing Post Termination Restrictions: There may be circumstances in which you need to ensure that former employees do not breach post termination restrictions, or other terms and conditions of employment which survive the termination of employment (including the duty of confidentiality, intellectual property as well as restrictions on poaching clients or colleagues). We can help you get effective results to protect your organisation’s essential interests.

General employment law advice and support: You may know the answer to a particular problem, but just want to talk it through with an employment law professional. We are always available to assist you and your organisation with ad hoc advice and support.
