Metropolitan Police Officer cleared of actual bodily harm following trial

A Metropolitan Police officer accused of striking a man during a raid on a property in east London has been cleared of causing actual bodily harm.

PC Adrian Daly, a firearms officer, formed part of a raid on a flat in West Silvertown in the early hours of 29 September, 2015

The complainant, a 29-year-old man, later lodged a formal complaint about his treatment stating he was punched in the back and kicked in the ankle by a police officer while he was in handcuffs.
An investigation was launched by the Independent Police Complaints Commission (IPCC) and in September 2016 concluded PC Adrian Daly may have committed gross misconduct and a file was passed to the Crown Prosecution Service (CPS).

The CPS made the decision to charge PC Daly on 16 March 2017 with grievous bodily harm. The charge was later changed to actual bodily harm.

Neil Orbell, IPCC Operations Manager, said: “Our investigation gathered evidence that suggested that a criminal offence may have been committed by an officer. This was supported by the CPS decision to charge.

“A criminal trial has been held and PC Daly has been cleared of committing actual bodily harm.

“Our investigation also concluded that an independent tribunal could find that PC Daly had breached standards of professional behaviour during the raid on 29 September, 2015 and has directed that a gross misconduct hearing be held.

“The IPCC will be in contact with the Metropolitan Police Service regarding scheduling this hearing.”
